Notaries in Casablanca: Role, Fees and How to Choose One

In Morocco, the notary (notaire) secures most property sales, especially when a bank loan is involved. Understanding the notary’s role helps you buy or sell in Casablanca safely.

    What the Notary Does

    • Checks the land title and any mortgages or charges
    • Drafts the sale promise and the final deed
    • Holds the buyer’s funds until the sale is completed
    • Pays registration duties and registers the sale at the land registry

    Notary Fees

Notary fees are often around 1% of the price, plus 10% VAT on those fees. They come on top of registration duty (usually 4%) and land registry fees (about 1.5%). See the full cost breakdown.

    Notary or Adoul?

Adouls can also draft property deeds in Morocco. For titled properties and bank-financed purchases, a notary is generally preferred and often required by banks.

    How to Choose a Notary

    • Choose your own notary rather than relying only on the seller’s.
    • Ask for a written estimate of all fees.
    • Make sure funds are paid to the notary’s official deposit account.
    • Ask how long registration will take.

    FAQ

Is a notary mandatory to buy property in Morocco?

A notarized or adoul deed is needed to register a sale. For titled properties and mortgages, a notary is the usual choice.

Can the same notary act for buyer and seller?

Yes, it is common, but you can appoint your own notary for extra protection.
